Definitions

 

“Accountability” the way that Being Natural Health Ltd. is responsible for the information collected and how this information is shared and used.

 

“Being Natural Health Ltd.” means Being Natural Health Ltd., a company incorporated under the laws of British Columbia, Canada

 

“Collection” refers to the act of gathering, acquiring, or obtaining personal information from any source, including third parties, by any legal means.

 

“Consent” voluntary agreement with what is being done, or proposed.  Consent may be expressed, which means it is provided in writing or verbally.  Implied consent exists when Being Natural Health Ltd. can reasonably infer (understand) consent based on a customer’s action or inaction.

 

“Customer” A customer of Being Natural Health Ltd. is any individual who purchased products through Being Natural Health Ltd. websites, signs up for our newsletter, a distributor of a Being Natural Health Ltd., or a merchant of Being Natural Health Ltd. products

 

“Disclosure” refers to the act of making personal information available to others outside of Being Natural Health Ltd.

 

“Personal Information” information that identifies and individual that is recorded in any form, except: an individual name, business title, business address and business phone number.

 

“Third-Party” is an individual or organization other than the customer or Being Natural Health Ltd.

1.0 Being Natural Health Ltd.’s senior staff is ultimately responsible and accountable for the protection of personal information.  However, on a daily basis, management of this information can be delegated to Being Natural Health Ltd.’s other staff members.

 

1.1 Being Natural Health Ltd. is accountable for personal information when it is in our control and Being Natural Health Ltd. is committed to using the appropriate security measures in the transfer of sensitive information.  Being Natural Health Ltd. advises customers that complete confidentiality and security are not assured.

 

1.2 Being Natural Health Ltd. is not responsible or accountable for any damages that may occur when a customer transfers or submits information through e-mail or wireless communication devices or when Being Natural Health Ltd. transmits personal information at the request of the customer. 

 

1.3 Being Natural Health Ltd. has worked hard to develop a gold standard in terms of its accountability.  We have created policies and procedures to ensure that: our customers’ information is kept as safe and secure as possible. Being Natural Health Ltd. is capable of receiving and responding to complaints and inquiries. All of our staff has been trained in our procedures and policies, and Being Natural Health Ltd. conveys our procedures and policies to our customers.

Principle 2: Identifying the Purposes of Collecting Personal Information

 

2.0 Being Natural Health Ltd. will identify the purposes for which information is being collected and how the said information is to be used either orally or in writing.

 

2.1 Personal information will only be collected in the best interests of the customer and to ensure a high level of customer service.

 

Principle 3:  Member Consent

 

3.0 Being Natural Health Ltd. will make reasonable efforts to ensure that customers understand how their personal information is used and disclosed.  Being Natural Health Ltd. will obtain consent from customers for all collection of personal information except where detailed in this code.

 

3.1 Being Natural Health Ltd. will collect personal information only when the customer has given consent.  Consent may be expressed, implied, or given through an authorized broker.  Consent may be withdrawn at any time, with some exceptions, and withdrawal of consent will go into effect as soon as is reasonably possible.

 

3.2 Being Natural Health Ltd. may obtain consent orally, in writing, or electronically.  Being Natural Health Ltd. will decide what level of consent is necessary, based upon the level of sensitivity of the information, on a case-by-case basis.  Being Natural Health Ltd. will not unreasonably withhold products or services from those who refuse or withdraw consent.  However, if information is reasonably required to operate our ordering systems, Being Natural Health Ltd. may decline to deal with a customer who will not consent to the use or disclosure of such information.

 

3.3 Consent may be refused by members at any time except when otherwise necessary due to contractual or legal arrangements, as well as required or authorized by law.  When refusing or withdrawing consent, Being Natural Health Ltd. must be given a reasonable amount of time to comply. Being Natural Health Ltd. withholds the right to refuse service to customers who refuse to give information that Being Natural Health Ltd. deems necessary to ensure its high level of service.

 

Principle 4: Personal Information Limits on Collection

 

4.0 Being Natural Health Ltd. will only collect information through lawful means for purposes that are available to the customer.  Information will not be collected indiscriminately or without an identifiable purpose.

 

Principle 5: Limits for Using, Disclosing, and Retaining Personal Information

 

5.0 Customer information will only be used for those purposes intended and made available to the customer.  Information will not be disclosed for other purposes without obtaining consent from the customer.

 

5.1 Being Natural Health Ltd. may use customer information for internal surveys to ensure that the best possible service is being offered to customers.  Based upon results of such surveys Being Natural Health Ltd. may enhance or develop new services for our customers.  When conducting such surveys, privacy will be our utmost concern and all attempts will be made to uphold our commitments to our privacy policies.  All surveys are voluntary and customers are under no obligation to participate in any Being Natural Health Ltd. sponsored survey.

 

5.2 Subject to all applicable laws, information may be transferred between employees of Being Natural Health Ltd. to ensure a high level of service while maintaining our safe and secure policies.

 

5.3 Being Natural Health Ltd. will not hold customer information for longer than is deemed necessary, or as stipulated by law.  Information will be destroyed, subject to law, when Being Natural Health Ltd. deems the information no longer to be necessary.

 

5.4 Being Natural Health Ltd. may disclose personal information to other companies when consent to do so has been given by the customer. 

 

Principle 6: Accuracy

 

6.0 Being Natural Health Ltd. will maintain as accurate information as is reasonably possible.  A reasonable effort will be made to ensure that customer information is accurate and current.  Being Natural Health Ltd. will attempt to make sure that information collected form customers remains up to date in order to ensure a high level of service that is both safe and secure.

 

6.1 Being Natural Health Ltd. will make a reasonable attempt to collect information from customers for purposes of accuracy.  Information will be requested if and when Being Natural Health Ltd. decides that it is in the best interests of the customer.

 

6.2 Customers of Being Natural Health Ltd. may contact our customer service representatives to update or check the accuracy of their information.  Being Natural Health Ltd. will make a valid effort to ensure that customers are able to update their information within a reasonable period of time.

 

Principle 7: Safeguarding Personal Information

 

7.0 Being Natural Health Ltd. will continue to make a strong effort to maintain a safe and secure database in order to prevent loss, theft, unauthorized access, disclosure, duplication, use, or modification of personal information.

 

7.1 Being Natural Health Ltd. will treat personal information differently depending on the sensitivity of the said information.  Security measures will differ based upon encryption level, availability, and access.

 

7.2 Being Natural Health Ltd. will use appropriate security measures when disposing of customer information.

 

7.3 Due to changes in technology and customer needs Being Natural Health Ltd. will continue to update and alter our procedures and policies regarding the protection of personal information.  The safety and security of personal information is extremely important to Being Natural Health Ltd. and will be continually kept in mind in the decision-making processes of Being Natural Health Ltd. employees.

 

Principle 8: Policy and Procedure Availability

 

8.0 Being Natural Health Ltd. prides itself in being wholly transparent to its customers and therefore is open about its operating policies and procedures.  Being Natural Health Ltd. will make every reasonable attempt possible to make these policies and procedures available to its customers. All policy and procedures that available to customers are provided free of charge by contacting the Being Natural Health Ltd. Privacy Officer.

 

Principle 9: Access to Personal Information

 

9.0 All Being Natural Health Ltd. customers have a right to access their personal information.  Being Natural Health Ltd. will provide access to a customer’s personal information as quickly as is possible.  Reasons for which Being Natural Health Ltd. is holding the said personal information will be provided to the customer.

 

9.1 Customers may be asked to provide Being Natural Health Ltd. with an explicit and specific request for the information that they desire to access.  Being Natural Health Ltd. may ask customers to provide their requests in writing to Being Natural Health Ltd.

 

9.2 Being Natural Health Ltd. will ask for as much information as is necessary in order to identify those customers requesting personal information in order to ensure that information is both safe and secure.

 

9.3 Being Natural Health Ltd. will provide information as quickly as is reasonably possible upon the receipt of an approved request.

 

9.4 Being Natural Health Ltd. will provide the customer with an estimate as to how much the information requested will cost and will allow the customer to cancel the request upon being advised of the estimated cost.

 

9.5 Being Natural Health Ltd. will inform the customer if and when a request for information is not possible.  Being Natural Health Ltd. will also provide a valid reason for why the request is not possible.

 

9.6 When deemed appropriate, Being Natural Health Ltd. will amend inaccurate or incomplete information.  If Being Natural Health Ltd. deems it necessary it will disclose the amended information to Third Parties.
